|Update: NEW STATE LAW SB-1186 Disability Access & Education Fee|
Effective January 1, 2013 State law SB-1186 adds a State fee of $1 on every application or renewal of a local business certificate (or equivalent instrument). The purpose is to increase disability access and compliance with construction-related accessibility requirements, and to develop educational resources for businesses in order to facilitate compliance with Federal and State disability laws. Every company/person doing business based in a commercial building in the City of Poway must obtain a business certificate. Contractors who are based in another city and are performing a contracted job in the City of Poway are also required to obtain a City of Poway business certificate. They must also have a business license from the city in which their business is based.

Initial application fee is $116.00. Bi-annual Renewal fee is $21.00. These fees are non-refundable, and include a $1 State Disability Access & Education fee.
A City of Poway Business Certificate protects the public interest, health, welfare and safety by ensuring that all new and existing businesses in the City are made aware of and conform to all City zoning, fire and public safety ordinances, rules and regulations. The business certificate fee recovers the administrative costs of processing the application for the issuance or renewal.

Credit Cards are required for online applications or renewals. If applying in person, cash, check or money order are accepted.
Three divisions review each business certificate: Building, Planning, and Fire/Safety Services. The normal processing time is approximately 7-10 working days.
CHANGE OF ADDRESS, OWNER OR BUSINESS NAME
Business Certificates are approved for a specific location, owner and business name and are not transferable. If any of this information changes a new application/certificate is required. The fee is $116.00.
LOCATION OF BUSINESS
The City of Poway has established various zoning regulations that control the location and operation of commercial activities. A brief check with the Development Services Department staff before signing lease agreements or purchasing commercial property may prove to be very valuable. FEDERAL EMPLOYER IDENTIFICATION NUMBER

RESALE LICENSE/ SELLER’S PERMIT
A seller’s permit number is required for all persons selling tangible property, which is subject to State Sales and Use Tax. For more information, contact the State Board of Equalization. STATE TAX IDENTIFICATION NUMBER / STATE ID

AGRICULTURE, WEIGHTS AND MEASURES -STANDARDS ENFORCEMENT

NORTH AMERICAN INDUSTRY CLASSIFICATION SYSTEM (NAICS) CODE
The North American Industry Classification System (NAICS) is the standard used by Federal statistical agencies in classifying business establishments for the purpose of collecting, analyzing, and publishing statistical data related to the U.S. business economy. FICTITIOUS BUSINESS NAME
The owners of a business who use a fictitious name (one other than his/her own name) for their business must clear the business name through the County Clerk to ensure no one else is using that name. State Law requires a Fictitious Business Name (FBN) statement be filed with the County Clerk to identify the name(s) of the owner(s) and the location of a business. An FBN statement needs to be filed every five years unless the business location or ownership changes. For more information contact the San Diego County Clerk. Any business that handles, prepares or sells food or edible items must contact the County of San Diego Environmental Health Department for a Public Health Permit. The permit number is required information on the City of Poway Business Certificate application.
SUBLEASING BUSINESS CERTIFICATION INFORMATION
If you are subleasing space from another business, you must provide the owner name and the business certificate number for that business. This information is used by Safety Services to determine if an additional inspection is required.
